			<content:encoded><![CDATA[<p>History has been taken out of context as it relates to the 10th amendment, according to Tina Benkiser who is referencing a paper written by David Barton of wall builders and speaking on behalf of Rick Perry.  Tina says Barton&#8217;s mission is to educate us on the Constitution!  That he is well-respected;  That she encourages &#8220;US &#8221; to listen to him.  Are the people of Texas so stupid that we can&#8217;t read this simple, short document for ourselves.  Are we so stupid that we do not know about a 1997 Supreme Court decision (Mack vs.Prinz)?  which re-affirms states rights?  Do we have to depend on David Barton to tell us what it means?</p>
<p>The above referenced statement was made in a debate where Tina Benkiser was representing Rick Perry, (where  Hutchison or even a surrogate didn&#8217;t show up) and Debra Medina.  Medina was outlining remedies available to the states including the 10th Amendment that check over reaching by the federal government.  This was in response to Tina&#8217;s defending Perry&#8217;s actions about not standing up to the feds on several policy issues. Tina Benkiser, stated that David Barton had written a &#8220;wonderful&#8221; article on how this amendment had been historically misinterpreted and that was why we had three branches of government &#8211; for each to reign in the other branches of government.</p>
<p>Medina responded that this was a ridiculous attempt to disavow the 10th Amendment; that if we expect three branches of government to police themselves there would be no checks for the states, which is what the 10th Amendment is all about. Below the video is a link to the debate where Tina said this and to David Barton&#8217;s hit piece on the 10th Amendment of the Constitution.</p>
<p>The reference court case, Mac v. Prinz, 1997,  stated in the final order pursuant to the Mack/Printz ruling Scalia warned, <strong>“The federal government may neither, issue directives requiring the States to address particular problems, nor command the States’ officers, or those of their political subdivisions, to administer or enforce a federal regulatory program. Such commands are fundamentally incompatible with our constitutional system of dual sovereignty.” </strong></p>
<p>It is rather obvious that nationalized healthcare and other federal mandates definitely qualifies as a “federal regulatory program.”</p>
<p>Typical Republicans would like you to think that you have no 10th Amendment rights and that the Perry&#8217;s hands are tied when dealing with the feds.  That is so Perry and his administration have an excuse to continue their cronyism with the money changers which continue to feed off your hard earned dollars and are perfectly happy to have mouthpieces like Barton and Benkiser who are &#8220;well respected&#8221; and &#8220;trusted&#8221;. Typical Republicans like Benkiser and Rick Perry like to say &#8220;trust then verify.&#8221;  Medina says &#8220;Verify &#8211; then trust &#8211; not the other way around&#8221;.</p>
<p>The statement by Benkiser and the paper by Barton are proof that we must verify first and then trust.  I have included a link to Barton&#8217;s paper below for you to read.  Do your own reading, listen to the video and decide whether you think we still have our 10th Amendment rights &#8211; cause folks, if we don&#8217;t, we might as well give it up!  Here is an &#8220;excerpt from Barton&#8217;s paper:</p>
<p><em>&#8220;Another similarly misunderstood but recently resurrected historic term is “nullification.” The revived use of this term has been the result of widespread dissatisfaction with federal intrusion into many areas that were formerly the sole domain of the states (e.g., education, transportation, health care, energy policy, etc.). Some leaders are now advocating state nullification as a constitutional solution – that a state has the right to declare a federal law unconstitutional, thereby nullifying that law.</em></p>
<p><em>For example, Texas gubernatorial candidate Debra Medina asserts:</em></p>
<blockquote><p><em>Texas must stop the overreaching federal government and nullify federal mandates in agriculture, energy, education, healthcare, industry, and any other areas D. C. is not granted authority by Article I, Section 8 of the U. S. Constitution….It is our duty as a state to recognize when Washington D. C. is stepping outside its constitutional bounds. Jefferson further commented that nullification by the states of all unauthorized acts is the rightful remedy….We must use the tools of nullification and interposition aggressively.&#8221;<a href="http://www.wallbuilders.com/LIBissuesArticles.asp?id=46525#FN4"><sup><span> </span></sup></a></em></p></blockquote>
<p>The rest of Barton&#8217;s paper is just as damning of the 10th Amendment; but again, read it for yourself and I think you will see the holes in it.  Maybe Mr. Barton just hasn&#8217;t heard of the famous court case Mack v. Prinz!.  I have read it and it is a poor attempt to persuade people that they have few rights.</p>

<p><strong>Report:  E-Verify Misses Half of Illegal Workers</strong></p>
<p>The system Congress and the Obama administration want employers to use to help curb illegal immigration is failing to catch more than half of the unauthorized workers it checks, a research company has found.</p>
<p>The online tool E-Verify, now used voluntarily by employers, wrongly clears illegal workers about 54 percent of the time, according to Westat, a research company that evaluated the system for the Homeland Security Department. E-Verify missed so many illegal workers mainly because it can’t detect identity fraud, Westat said.</p>
<p>“Clearly it means it’s not doing its No. 1 job well enough,” said Marc Rosenblum, a researcher at the Migration Policy Institute, a nonpartisan Washington think tank.</p>
<p>E-Verify allows employers to run a worker’s information against Department of Homeland Security and Social Security databases to check whether the person is permitted to work in the U.S. The Obama administration has made cracking down on employers who hire people here illegally a central part of its immigration enforcement policy, and there are expectations that some Republicans in Congress will try in coming weeks to make E-Verify mandatory.</p>
<p>Much of the criticism of E-Verify has focused on whether U.S. citizens and legal immigrants with permission to work were falsely flagged as illegal workers. Immigration officials have been taking steps to improve such inaccuracies. Westat reported that 93 percent of the cases checked were legal workers who were accurately identified on first try. Another .7 percent were legal workers who initially were rejected.</p>
<p>Homeland Security Secretary Janet Napolitano, testifying in a House hearing on her agency’s proposed budget Thursday, said she doubts the 54 percent inaccuracy rate for illegal workers. She said things are being added to the system to root out identity fraud.</p>
<p>“E-Verify is absolutely where we are going in terms of incentivizing employers and making sure we are using a legal work force,” Napolitano said.</p>
<p>Sen. Chuck Schumer of New York, who is writing the Democrats’ immigration bill and has fought expanding E-Verify because of its flaws, said Wednesday that the fact that E-Verify was inaccurate so often shows that it is not an adequate tool.</p>
<p>“This is a wake-up call to anyone who thinks E-Verify is an effective remedy to stop the hiring of illegal immigrants,” Schumer said.</p>
<p>A worker verification process like E-Verify is considered essential for any immigration overhaul proposal to have a chance of approval in Congress.</p>
<p>Westat’s report, completed in December using data from 2008, was quietly posted on Homeland Security’s Web site Jan. 28 along with a summary that pointed out E-Verify is accurate “almost half of the time.”</p>
<p>“While not perfect, it is important to note that E-Verify is much more effective” than the paper forms used by most employers, the summary said.</p>
<p>Rosenblum, who has studied E-Verify, said Westat’s evaluation shows it doesn’t make sense to substantially expand and invest in E-Verify without fixing the identity theft problem.</p>
<p>Bill Wright, a spokesman for U.S. Citizenship and Immigration Services, said the agency has created an anti-immigrant identity fraud unit in Buffalo, N.Y., to address the issue.</p>
<p>The agency, part of the Homeland Security Department, is developing a way for people to screen themselves through E-Verify so they can show potential employers they can work legally.</p>
<p>About 184,000 of the nation’s 7 million to 8 million employers are using E-Verify, according to the Homeland Security Department.</p>
<p>Congress gave DHS about $100 million to spend on E-Verify in its 2010 budget.</p>

<p>Debra Medina for Governor of Texas</p>
<p>I am Sandra Beene, co-founder of <a href="http://www.medinafortexas.com/www.TXMinutemen.com" class="broken_link" >www.TXMinutemen.com</a> which is a border watch organization. We have had 12 very successful border watches to date, in the area east of El Paso, with not 1 single negative incident with the law, or any other problem. We are lawful and only report to the border patrol or Sheriff on anything we see. And, we are mostly Texans fighting for Texas.</p>
<p>Upcoming elections for TX governor:</p>
<p>KB Hutchison is a lying sellout who has been the queen of ear marks in the Senate and proud of it. She also is the one who gutted the funding for the border fence, effectively negating the building of said fence. And she has been openly voting for stimulus bills and passing midnight votes for huge numbers of green cards while she &#8220;claims&#8221; to be conservative. She also has had great campaign contributions from huge TX company, Zackary construction, who have the construction contract for the NAFTA super highway.</p>
<p>When Hutchison was asked if she would use the 10th amendment to stop the feds from confiscating our guns, she would not answer the direct question.</p>
<p>She is a spoiler who will damage Texas even more than she has already.</p>
<p>R Perry has greatly increased the number of illegal aliens in our state and even granted them a lesser cost than a US citizen if they want to go to college in TX. He also raised the tax rates for small business which cuts their hiring. And he babbles, only during elections, about how he will save TX from our current illegal invasion. BUT in 10 years he has done NOTHING except talk.</p>
<p>Perry is also responsible for a mandatory injection of all young girls with an untested vaccine, Gardasil, that might reduce the odds of getting cervical cancer. Of course the fact that the maker Merc contributed to his campaign funds might have influenced him greatly. This dangerous plan was only stopped due to an uproar from intelligent, outraged, and alarmed parents.</p>
<p>Perry also wanted to build the NAFTA super tollway (TTC) and is still intent on building it even after Texans demanded he stop. He is like congress in that he only cares about what he wants and NOT what Texans want. The TTC would have taken millions of acres of TX farm and ranch land and changed it into pavement that would profit a company from Spain, not Texas. Of course his son was on the board of the Spanish company which might have been a factor.</p>
<p>Perry also has had great campaign contributions from huge TX company, Zackary construction , who have the construction contract for the TTC or NAFTA super highway.</p>
<p>When Perry was asked if he would use the 10th amendment to stop the feds from confiscating Texas guns, he would not answer the direct question.</p>
<h4>Debra Medina</h4>
<p>As co-founder of the TXMinutemen, I strongly endorse Medina as she is NOT a career politician nor a liar and will follow the constitution to the letter.</p>
<p>She is a small business person and understands how damaging it is to have a governor who raises taxes on small business owners. Medina also wants to erase taxes on property and make up the short fall via expanding the sales tax on business that are not taxed now, such as massage parlors, tattoo parlors, etc.. But no tax on food and prescription drugs.</p>
<p>Medina is strong on the 2nd amendment and has been endorsed by many second amendment associations. She will also use the strength of the 10th amendment to stop the feds from coming into TX and imposing unconstitutional laws or confiscating guns. 30 other states are working right now on how they will apply the 10th amendment. This is very important because confiscation is coming and Perry and Hutchison will not stand against it.</p>
<p>Medina is serious on securing the TX border, which we desperately need as nobody in the state or at federal level has done anything about this.</p>
<p>Medina offers, for the 1st time in 30+ years, the chance to elect someone who is honest and a patriot.</p>
<p>Will Medina do everything I want and the way I want? NO and I would be amazed if I found a candidate who would.</p>
<p>Is she hand&#8217;s-down better than anyone else running for TX governor? YES YES YES by a very long shot.</p>
<p>Don&#8217;t waste your vote on people who have lied to you every day, year in and year out, and have NO intention of keeping their word or doing any of what you want done.</p>
<p>It is time to dump the career political hacks and get new blood.</p>
<p>It is time to elect an honest person who actually wants to do the right thing FOR Texas. We have not had that for over 50 years.</p>

All of a sudden Rick Perry is suing the EPA and has a new commercial supporting the 10th Amendment which keeps the federal government from overreaching into state affairs.  Of course they are only questioning the economic impact of the latest EPA laws - not the federal government's right to impose them. Debra Medina has had these two issues as part of her platform since she began this race.

			<content:encoded><![CDATA[<p><a href="http://www.debramedinafortexas.com/wp-content/uploads/2010/01/debateperrymedina12.jpg"><img class="alignleft size-medium wp-image-1113" style="border: 4px solid black; margin: 8px;" title="debateperrymedina12" src="http://www.debramedinafortexas.com/wp-content/uploads/2010/01/debateperrymedina12-300x226.jpg" alt="" width="300" height="226" /></a>or just lying to the people again?  All of a sudden Rick Perry is suing the EPA and has a new commercial supporting the 10th Amendment which keeps the federal government from overreaching into state affairs.  Of course they are only questioning the economic impact of the latest EPA laws &#8211; not the federal government&#8217;s right to impose them. Debra Medina has had these two issues as part of her platform since she began this race.</p>
<p>One thing you will never see Perry quote is the following Supreme Court decision. This is a quote from the website citing the Supreme Court ruling:</p>
<p>Scalia warned, <strong>“The federal government may neither, issue directives requiring the States to address particular problems, nor command the States’ officers, or those of their political subdivisions, to administer or enforce a federal regulatory program. Such commands are fundamentally incompatible with our constitutional system of dual sovereignty.”</strong></p>
<p>So when Perry gets on TV and says he is a supporter of the 10th amendment he is lying.  He&#8217;s been in office for 9 years and has NEVER told the federal government to keep out! I would bet Perry&#8217;s pollster has seen that these issues resonate with the people and as always with Perry he has his finger in the air testing which way the wind in blowing.</p>
<p>In previous commercials Perry has heralded his jobs creation, his fiscal responsibility and the &#8220;great&#8221;  Texas economy.  Well, Texans are on to that BS so I guess his strategists figured it was time to say the things that they see drawing voters to Debra Medina.</p>
<p>He&#8217;s lied about the Trans Texas Corridor being dead.  This land grab of private property and open borders is one of the biggest threats that Texas citizens face.  Yet during campaign season he tells us it is dead, while all along the Perry&#8217;s Transportation agency is moving full steam ahead.</p>
<p>He&#8217;s talked about cutting state agencies by 5% which won&#8217;t make up for the growth we have seen in the state government in the past year.  And so why in 9 years hasn&#8217;t he already severely limited spending in state agencies?  Because it&#8217;s now campaign season, that&#8217;s why and the arrogant elitist thinks people are so stupid that he can lie and get away with &#8211; he has lied before &#8211; so why not again?</p>
<p>Now Perry seems to be championing the 10th amendment.  If he really does &#8211; he would have said something before NOW and he would be suing the EPA on CONSTITUTIONAL grounds, not a wimpy  it will hurt Texas economically.</p>

<p>Inexperience and youthful enthusiasm for obeying not only the U.S. Constitution, but also the Texas Constitution, could be really refreshing.   More refreshing would be the election of a down home, country girl who would bring some common sense to our state government. One thing is for sure: she is not bought and paid for by the special interests and will have nothing to do with the internationalist, globalist, New World Order elitists who have had a death grip on our state and federal governments for far too long.</p>
<p>The Governor of Texas is only one sixth of the executive branch and has very little power except to veto legislation and appoint bureaucrats.  The &#8220;Trillion dollar economy of Texas&#8221; is not under his command; albeit, he would like it to be.  His ignorance and violation of the Texas Constitution is evident by the fact that he pretends he can &#8220;legislate&#8221; by &#8220;executive order.&#8221;  As I have written before, the Governor&#8217;s executive orders are only applicable to those area under his direct supervision.  He has no power to legislate and intrude into the prerogatives of the House and Senate&#8230;as he tried to do with the vaccine issue, and for which the Legislature slapped him silly.</p>
<p>I would much rather have someone who understands the true function of the Governor&#8217;s duties and is dedicated to obeying our Constitutions than an &#8220;experienced politician&#8221; who would love to be &#8220;dictator for life.&#8221;  Rick Perry has shown his true colors too many times to be trusted.  Let&#8217;s get a new broom and sweep some things clean at the State capitol.</p>
<p>For these reasons, we are supporting Debra Medina for Texas Governor.  She has shown much courage in her stand to not just blindly support the possible “lesser of two evils” just because they might be of the Republican stripe.  What a breath of fresh air!</p>

Berman Urges Caution With Medina<br />

<p>There is something new in American politics. Americans, sensing a loss of freedom and a lack of representation with the president, his administration and Congress, have joined to form organizations known as &#8220;tea parties,&#8221; &#8220;We the People,&#8221; and &#8220;9-12&#8243; groups. These groups are credited with delaying the Obama administration&#8217;s take-over of the U.S. health care system.</p>
<p>Recently, I spoke to a large rally of combined grassroots organizations in Austin. The subject was nullification, a process by which a state legislature sends a message to Washington that the state will not comply with unconstitutional or Socialist mandates.</p>
<p>At the conclusion of the program an impromptu demonstration erupted for Debra Medina, a Republican candidate. I was concerned. The incident reminded me of the 2008 presidential campaign when candidate Barack Obama said, &#8220;We live in the best nation in the world, now help me change it.&#8221;</p>
<p>By every measure, Texas is clearly recognized as the No. 1 state in the union. We are the envy of the remaining 49 states. Our budget is balanced, our taxes are low and our business climate is considered the best in the nation. I credit Gov. Rick Perry&#8217;s fiscal leadership for today&#8217;s Texas success story.</p>
<p>Many concerned citizens, who currently number among the members of the new grassroots organizations, complained that Obama did not have the background or experience to serve as president of the United States. Some of these same citizens are now prepared to turn over the trillion-dollar Texas economy to an inexperienced candidate, who has no legislative or executive background, to serve as the chief executive officer of this great state. While I admire her passion and believe she has future potential, now is not the time to discount Perry&#8217;s strong leadership.</p>

<p>I would legalize Hemp and offer industrial incentives for the many, many products which can be made from hemp including, nutritious oils, alcohols, deisel, and fuel combinations, as well as Rayon fabric, rope, cosmetics, nut butters, canary food and a thousand others.  But yes, I would  also legalize Marijuana both for Medicinal use and recreational use for legal aged adults of whatever any particular state considers adulthood.</p>
<p>I would mandate the use of a $100 water cooled de-superheater component on all new outdoor air-conditioning system condensers.   The end consumer can then produce 300 gallons of waste hot water per day, for FREE like in hot water heater and hot tub per ton of air conditioner kinda FREE.  You just eliminated 75% of your monthly energy bill at home and two or three years from now that 75% will be going directly in your pocket.</p>

<p>Sometimes when you are just looking around on the Internet you can discover some interesting items, like an article titled <em>Hutchison Slices Into Perry’s Donor Base</em> by W. Gardner Selby at the <a href="http://statesman.com/" target="_blank">statesman.com</a>. I would like to just lift a few quotes.</p>
<p>“Hutchison&#8217;s finance chairman, John Nau of Houston, said the Perry-to-Hutchison shifts were rooted in promises made to Hutchison when she bowed out of challenging Perry in 2006 …Nau, a former Perry appointee to the Texas Historical Commission, said he helped Perry backers dissuade Hutchison from challenging Perry in 2006. At the time, Nau said, Perry told him: Next time is her time.&#8221;</p>
<p>Some may wonder why this kind of information about Perry and Hutchison are on a web page designed for Debra Medina. I hope it will give you a view of just how Perry and Hutchison and their money backers view the Governor’s office. “It’s his time, it’s her time…etc,” as though the office of governor is theirs to swap and trade. There seems to be absolutely no consideration to the wishes of the ordinary voters.</p>

			<content:encoded><![CDATA[<p><span style="font-family: MS Sans Serif;"><span lang="EN">When Bill White entered the race for Governor of Texas a couple of weeks ago, the tectonic plates of the political landscape of Texas made a dramatic shift. There could very likely be a violent eruption either in the March Primary or certainly no later than the November General Election. The initial shift was enough to make two declared Democratic candidates for Governor decide to withdraw from the race. There has not been much public notice given to this dramatic change yet, but failure to recognize what is happening by the Republican Party and its leaders, could cost them their decades long domination in Texas Politics.</span></span></p>
<p>Yes, White is being recognized as the Democratic shoo-in.  Most coverage on the Republican side continues to focus on the Perry-vs-Hutchison squabble and totally ignores the question of, “how can either of them now counter Bill White in the General Election?</p>
<p>There is virtually no mainstream coverage being given to Debra Medina the &#8220;We Texans&#8221; candidate for governor. Traditional  wisdom is that without raising $5 million or more, a candidate can’t win (or buy) this election. Certainly Medina has not tapped into those kinds of funds (yet.)</p>
<p>However, the serious question that the Republicans should be asking is not &#8220;can Medina win in the Primary&#8221; .but is there a chance that either Perry or Hutchison can beat Bill White in the General Election in November?</p>
<p>I am not sure if the Republicans are willing to acknowledge yet, that the fact Obama is in the White House today, is because of the conduct of their own party political leaders in looking the other way at the Bush Administration’s repeated violation of the party’s platform and our Constitution. Perry has made sure that Hutchison cannot separate herself from the national disaster of her 8 year voting record, when she voted over 90% of the time in agreement with the Bush policies. Likewise Hutchison has rightly reminded the Texas voters how Perry showed no interest in protecting property rights for Texans by his aggressive &#8220;in your face&#8221; support for the TTC, which is not dead as he repeatedly claims, but has only had a facelift and a name change to the North American Inland Ports Network. White has been handed a silver platter and the knife to carve them both up in the General Election, just by replaying their own political commercials.</p>
<p>Now lets look at how White will stack up against Medina. While the Republicans vote turn out may not be as large as usual, since the Republican Party is in general disarray both nationally, at the state level and in local communities, there will be a &#8220;slim to none&#8221; chance of Republicans crossing over to vote Democratic. While it is true Democratic leaders are smelling &#8220;blood in the water&#8221; at the chance to run against Perry or Hutchison, they are aware that Medina’s campaign has a lot of attraction for many of their traditional voters. Just her name will draw some support. Also many Democrats are very disappointed in the &#8220;change&#8221; they have received from the Obama administration. It was not the &#8220;change&#8221;"we know better than the voters.?&#8221;</p>
<p>While the ground has certainly shifted in the Texas political landscape in the last few weeks, it is still in the hands of the Republican Party leaders to decide if they will themselves cede their long standing political dominance to the Democratic Party, or will they support the candidate of the people and show the nation that Republicans can still win &#8220;big&#8221; when they support the principles for which they claim to stand!</p>

			<content:encoded><![CDATA[<p>The political landscape changed greatly in Texas with the entry of Bill White into the Governor&#8217;s race.   So much so that one potential candidate Hank Gilbert has decided to run for Agrlcultural Sectetary instead of Governor. Democrats smell blood in the water and see the potential for victory.</p>
<p>Have  the Republicans taken notice yet, or do they still have their heads in the sand.  I, like many other may have previously considered that the Governor&#8217;s race would be over when the results of the Republican Primary are reported, but that is no longer true.</p>
<p>The question being asked now should not be, &#8220;Does Debra Medina really have a chance in March?&#8221;  The question should be, &#8220;Do either KBH or RP have a chance of winning in November?&#8221;</p>
<p>I see a McCain-Obama election repeat in Texas, if the Republican party continues to ignore Debra Medina. Perry is not polular in Texas. He only received 39% of the votes in the last election. Also the voters are learning that the TTC is not dead, only the name has been changed to North American Inland Port Network. You can google it to learn more.  Likewise, there is an anti-incumbant movement sweeping across Texas and the nation.<br />
The best bet for the Republicans is to wake up and throw their full support  behind Debra Medina. She is not an incumbant. She is the candidate of the Tea Parties and she is committed to the conservative principles of the Republican Platform.<br />
Bill White can make mincemeat of the records of KBH or RP. Indeed, they have given him enough ammunition in their attacks on one another already . Medina will make mincemeat of White&#8217;s record.<br />
Join the team, &#8220;Medina for Governor in 2010!&#8221;</p>
