Dear Ms. Medina,

I enjoyed the debate that you shared with Governor Perry and the Senator. I felt that you did a terrific job. However, I do have a question about EMTALA. If I understood you correctly, you said that you would repeal the law. Could you please explain your rationale? The law prevents hospitals from dumping unstable patients on another hospital and assures that emergency medical care is received regardless of a person’s insurability.

I am looking forward to your response.

Thank you,

(The Advance Care Directive)…..There is none more innocent than the unborn babe, or the frail, injured and dying.” “Texas deserves Pro-life support.” Debra Medina Questioner: “It was signed when you were Lt Governor….. Perry: “I wasn’t aware of that.”

Audience Question: The Texas advance directive act, also known as the Texas futile care law gives hospitals ethics panels the power to discontinue life giving care to any patient whose causes they deem futile, if the patient is not able to transfer to another facility within 10 days of being notified of the panel decision These panels however have come to consider as futile, patients who are conscious, able to request care, and able to pay. So keeping in mind that Texas is the only state with such a law, what changes would you support being made to the Texas Advance Directive?”

Senator Hutchison: “To be very honest with you I was not aware that we had a law like that.”

Governor Perry: “I always stand by the side of life and in this case it is no different. Ah…You do every thing you can to keep those patients alive and certainly working with those physicians there if they don’t have ah…ah… you stand by life in this state.”

Moderator: “So would you make an effort to repeal it?”

Perry: “Absolutely if that is what we are seeing in Texas today, absolutely.”

Medina: “I am a registered nurse; I’ve been at the bedside of patients affected by the Advance Directive Act. I know the grieving that families go through. The governor does a great job of giving lip service to pro-life issues but he’s done little to reverse abortion here in Texas and he’s done nothing,…. 9 years if you were going to repeal the act why haven’t you. It’s been there, we have been denying care, we have been pulling patients of ventilators when they and their families didn’t want that to happen because the law in Texas allows it. Texans deserve pro-life support. Gov job is to insure justice and to protect innocent life. There is none more innocent than the unborn babe, or the frail, injured and dying.”

Follow up from Questioner on the floor: “this is for Governor Perry only. The bill was signed into law when you were Lt. Governor, did you oppose it at that time as well?”

Perry: I wasn’t aware of that.”

‘ & –>Posted Tuesday, Jan. 19, 2010

AUSTIN — After months of being largely dismissed in a race dominated by the state’s two Republican heavyweights, Debra Medina is making her presence felt with an anti-establishment message that has evidently struck a chord among a segment of Republican voters.

Buoyed by her performance against Gov. Rick Perry and U.S. Sen. Kay Bailey Hutchison in last week’s televised debate, the conservative activist has climbed to 12 percent in the latest Rasmussen Reports poll, up from 4 percent in November, a showing that prompted organizers to include her in a second debate Jan. 29.

“Her performance in the debate made her the legitimate and credible ‘none-of-the-above,’ ” said Harvey Kronberg of the Austin-based Quorum Report, an online political newsletter.

While Medina remains a distant third with little realistic hope of pulling off an upset, experts say, her recent burst of momentum has enhanced her credibility and raised the prospect of forcing Perry and Hutchison into a runoff after the March 2 primary. The Rasmussen team called Medina “the only candidate who is gaining ground.”

At the same time, analysts say, the broader attention has made Medina a bigger target, increasing scrutiny on some of her more controversial positions. Perry and Hutchison may also be inclined to toughen their attack against her at next week’s debate at WFAA/Channel 8 in Dallas. The debate, sponsored by Belo TV stations and The Dallas Morning News, was initially limited to the two leading candidates. But on Monday, organizers said they expanded it to include Medina based on her improved poll standing. Medina supporters had protested their candidate’s exclusion.

In a telephone interview Tuesday, Medina said the political bounce has generated more than $60,000 in contributions over the past four days, infusing her campaign with a “tremendous amount of new enthusiasm and excitement.”

During Thursday’s debate in Denton, hosted by KERA/Channel 13 and co-sponsored by the Star-Telegram, Medina underscored her views for whacking government regulation and depicted Perry and Hutchison as establishment politicians.

Medina, a former Wharton County GOP chairwoman, also touted signature themes of replacing property taxes with sales taxes and removing government controls over gun ownership.

Medina’s message resonates with participants in last year’s Tea Party protests against rising taxes and burdensome regulations from Washington, analysts say.

Tarrant County Republican Chairwoman Stephanie Klick said Medina is also drawing support from voters who haven’t been active in party politics.

“She appeals to a lot of these newcomers,” Klick said. “I think there are a lot of people who didn’t know there was a third candidate in the race.”

“She’s definitely the candidate of discontent right now, and it’s a good time to be the candidate of discontent,” said Jim Henson, director of the Texas Politics Project at the University of Texas at Arlington. Her challenge over the next six weeks, he said, will be to “to portray herself as a political outsider but not an extremist.”

……… and will campaign as a Democrat Taxi owner/operator, and alternate energy systems design engineer, all Day for Medina. If I were running for Governor I would have a near identical platform, with ONE very important distinction. I would not outright legalize All drugs. Same with home grown mushrooms, brew, wine and the like. Everything would be taxed alike according to health detriment.

I would legalize Hemp and offer industrial incentives for the many, many products which can be made from hemp including, nutritious oils, alcohols, deisel, and fuel combinations, as well as Rayon fabric, rope, cosmetics, nut butters, canary food and a thousand others. But yes, I would also legalize Marijuana both for Medicinal use and recreational use for legal aged adults of whatever any particular state considers adulthood.

I would mandate the use of a $100 water cooled de-superheater component on all new outdoor air-conditioning system condensers. The end consumer can then produce 300 gallons of waste hot water per day, for FREE like in hot water heater and hot tub per ton of air conditioner kinda FREE. You just eliminated 75% of your monthly energy bill at home and two or three years from now that 75% will be going directly in your pocket.

We think a Medina upset is within reach. Political machine candidates are not what the people are looking for; and the supporters of political machine candidates have nowhere near the energy and passion that Medina supporters have (we wouldn’t be surprised in the least if large numbers of publicly named supporters of both Perry and Hutchison will happily use the privacy of the voting booth to vote for Medina).

Debra Medina

Hers is a name that hasn’t made to the national media; the March 2nd Republican Primary in the state of Texas is still too far away. But we predict you will hear about her, and we wouldn’t be surprised if she pulls off a stunning upset by winning or forcing a runoff for the Republican nomination for Governor of Texas. Here’s why.

The favorites of the Republican establishment are either the incumbent Governor Rick Perry, who has been in office since 2000, or Kay Bailey Hutchison, who has been a US Senator since 1993. Perry hasn’t been a bad Governor; by most measures, Texas has outperformed most other states during his tenure, and he’s won re-election twice. Hutchison, too, hasn’t been a bad Senator, having reflected and stood for the generally conservative views of those who elected her (and she’s also been re-elected twice). So how could they be vulnerable?

First, because their egos are driving their candidacies far more than any passion for principles. Perry has no compelling reason to be running for a third term, except that he likes power and wants to burnish his credentials as a Presidential or Vice-Presidential candidate in 2012 and thinks maintaining his governorship is better for doing so than not. Perry looks and talks like a semi-conservative version of Bill Clinton—which is to say, too slick for his own good. Hutchison has even less reason for seeking the governorship. She has personal reasons for wanting to move from DC back to Texas; she needs something to do; she thinks of herself as Political Class Royalty, and so she thinks she ought to be ‘awarded’ the governorship. Perry messed up the crowning ceremony by deciding to run for another term.

Second, while Perry is far more astute than Hutchison in sensing the people’s anger toward Obama and the radical leftists, both Perry and Hutchison give off the unmistakable air that we are in normal times where normal political banter and argument over tweaks to this or that issue are what the people want to hear. They are dead wrong, especially as to the people who are hell-bent to vote on March 2nd in Texas. And that’s why Debra Medina may shock the political world.

Debra Medina is not glamorous; she is not slick; she is not super-smooth and polished. In all of those respects, she is like most of us. But, like most of us, she’s intelligent; she’s genuine; she doesn’t lie; and she knows the difference between truth and BS. She doesn’t pretend to have all the answers; but she knows the starting point for getting to the right answers is the US Constitution and the Texas Constitution, and adhering to the enduring principles they embody, including limited government, respect for private property, and the rule of law. She is passionate about the rightness of those principles, as most Americans are. And she knows these are not normal times; they are times of unprecedented, radical, unconscionable, unconstitutional government assault on our freedoms and our way of life as Americans. She is a tea partier; Perry and Hutchison are not. Hutchison in particular would much rather stay in her limousine and drive on by the tea party events.

Medina had her shot on stage last night in a three-way debate among the Republican candidates. We don’t bother to read debate reviews by mainstream media pundits (we don’t read anything in the mainstream media anymore), but we suspect most are caught up in the old ways of sizing up debates in terms of who got off the best zingers, who stumbled, who dazzled, etc., as against some mythical perfect Hollywood-style candidate who doesn’t exist and has never existed. For our money, Medina connected. She cares, she is fed up with political elites, she bleeds American/Texan, and she’s unapologetic about the need and duty of political officeholders to honor and abide by constitutional limits on what government can do.

Perry and Hutchison and the Republican establishment have apparently agreed to a second debate which will not include Medina. The people will see this as nothing but pure elitism—more of the same from a Political Class that reeks of condescension toward the American people. Medina will gain even more momentum from that decision.

An all-American surge is sweeping the country in a nick of time. Even if Scott Brown gets derailed by a late hit by the media and ACORN/union-driven fraud, and even if Debra Medina can’t quite overcome the Texas Republican establishment, their cause is the same: restoring the America of the founding, for the benefit and blessing of all Americans. That cause is going to prevail.

Prediction: Watch the big GOP Patronage system swing into full gear. Medina hit a “home run” at last nights KERA debates according to some media outlets and TX 21 news analysts declaring her the winner. Now watch the “Party” swing into actions. Expect GOP heavyweights to do everything they can to either 1) keep Medina out of the limelight, and/or 2) pressure her to drop out “for the good of the Party”.

Medina won’t bite however, which will send the “Party” into a tailspin. After all, they are used to swinging their weight around and getting their way – but his only works with people who believe the “Party” is important. Medina sees the Party mechanism as a patronage system instead of a structure to support freedom and prosperity through electing candidates who support the U.S. and Texas Constitutions.

If Medina doesn’t show enough support to effectuate a runoff she will be labeled a “spoiler” by the Party machine. I think though, that many regular Texans know better – they are tired of the same old rhetoric and are willing to take a chance with Medina.

And if she doesn’t win this time she will be back in 1214. Kay may think she has a “new best friend” by skillfully pulling in Medina to back her up on the tax increase argument, but she may be surprised. Medina is not a friend of big government or those who support it. While she may agree with Kay on one policy issue Medina is also principled and will not compromise “for the Party” or anyone else.
